Terms of Use

1. Agreement to Terms

By accessing or using the Spamurai application ("App") or the spamurai.pro website ("Website"), collectively the "Service," you agree to be bound by these Terms of Use. If you do not agree, do not use the Service.

In these Terms: "We," "Us," or "Our" refers to Gall Agencja Interaktywna Arkadiusz Galler (NIP: 6312586148), ul. Przyszlosci 18/1, 44-119 Gliwice, Poland. "You" or "User" refers to any person who accesses or uses the Service.

2. Service Description

Spamurai is a desktop email filtering application that uses artificial intelligence to classify, organize, and manage your email. The App connects to your email accounts, analyzes incoming and historical messages, and automatically keeps or removes emails based on your configured rules and confidence thresholds.

Spamurai is a productivity tool. It does not guarantee 100% accuracy in email classification. Important emails may occasionally be misclassified. You are responsible for reviewing the app's decisions, especially during the initial learning period.

3. Account Registration & Security

• One account per person. You may not create multiple accounts.
• You must provide accurate information when registering.
• You are responsible for maintaining the security of your account credentials.
• Spamurai uses a one-active-device model: only one device may be active per account at any time. Activating the app on a new device automatically deactivates the previous one.
• Your device sends periodic heartbeat signals to confirm it is active. If no heartbeat is received within 24 hours, the device is considered inactive.

4. Email Access & Permissions

By connecting your email account to Spamurai, you grant the App permission to:

• Read email headers and bodies
• Move emails to trash or restore them
• Permanently delete emails
• Apply labels (Gmail) or move to folders (IMAP)
• Mark emails as read
• Trigger one-click unsubscribe (RFC 8058) with your confirmation

Spamurai cannot:

• Forward, copy, or extract emails outside the application
• Access contacts, calendar, or non-email data
• Send emails on your behalf

5. AI Processing & Data Handling

Spamurai offers three AI provider modes. You choose which to use:

• Spamurai AI — Email metadata (and optionally body) is sent to our server and forwarded to Google Gemini. Data transits but is not stored.
• BYOK (Bring Your Own Key) — Data goes directly from your device to Google's API. Never touches our servers.
• Ollama (Local) — All processing runs on your device. Nothing leaves your machine.

By default, Spamurai only analyzes email subject lines and sender information. Body classification is optional and must be explicitly enabled. Emails flagged as containing sensitive content (medical, legal, financial, etc.) skip body analysis by default.

6. Subscription Tiers & Billing

Tiers

Spamurai offers Free, Coffee, and Pro tiers with varying daily processing limits, linked accounts, and features. Business and Enterprise tiers are planned ("Coming Soon").

Add-ons

Optional paid add-ons (additional history credits, additional linked-account slots, and Team Features) are available on paid tiers only. Add-ons follow the billing cycle and currency of your subscription, and are not available on the Free tier.

Billing Cycle

Paid plans are billed on a monthly cycle. Payments are processed via Stripe in PLN, USD, or EUR.

Upgrades

Upgrades take effect immediately. If upgrading within the same currency, you receive prorated credit. If switching currencies, a new billing period starts.

Downgrades

Downgrades between paid tiers take effect at the end of the current billing period. You retain full access until then. Before confirming a downgrade, the portal displays a preview of the impact on linked accounts, history credits, team seats, and add-ons. The Free tier is not reachable through the downgrade flow — to move from a paid plan to Free, cancel your subscription (see "Cancellation" below).

Cancellation

You may cancel at any time from the Billing section. Access continues until the end of the current billing period, after which you are moved to the Free tier. Active add-ons (including Team Features) are cancelled together with the subscription.

Payment Failure

If a payment fails, you receive a 3-day grace period with continued access. If not resolved, your account is automatically downgraded to the Free tier.

Taxes

All prices displayed on the Website and in the App are net prices (excluding tax). Depending on your country of residence, VAT or other applicable taxes may be added at the time of payment. The total amount including any applicable taxes is shown before you confirm your purchase. You are responsible for any taxes imposed on your subscription payments under applicable law.

Pricing Changes

We reserve the right to change pricing with reasonable notice. Existing subscribers will be notified before any price change takes effect.

7. Team Features & Organizations

Team Features are an optional paid add-on available on Coffee and Pro tiers. When enabled, your account becomes the owner of an organization that can host other Spamurai users as seat holders under your plan.

Owner Responsibilities

As the organization owner, you are responsible for the conduct of seats you invite, for the lawful basis on which you invite them, and for any communications you make to them about Spamurai. You may not invite users without their consent or pretend to act on Spamurai's behalf.

Seat Pool & Pool Modes

Your plan exposes a pool of seats that the organization shares. Each accepted invite consumes one open seat. Owners may operate the pool in Shared mode (all mailboxes draw from a single pool of daily, analysis, and history quota) or Split mode (per-mailbox caps). Caps are stored across mode switches but are only enforced in Split mode.

Invites

Invites can be scoped to anyone with the link, a specific email domain, or a specific email address, and may carry default per-mailbox caps and a maximum number of redemptions. Pending invites do not reserve seats; capacity is checked when an invite is redeemed inside the Spamurai desktop app.

Seat Holder Status

If you redeem an invite, your account is linked under the inviter's organization. The owner can see the linked email, set per-mailbox caps, rename the organization, and revoke your access. Owners cannot read your emails, see your filtering rules, or act inside your inbox — those remain on your device under your sole control.

Revocation & Pause

When an owner revokes a seat, that mailbox is paused immediately and moves back to the holder's personal organization. The mailbox loses any history bonus tied to the team plan, but its own decision counter follows it. If the owner cancels Team Features or the underlying subscription, all seats are revoked at the end of the billing period and affected mailboxes are paused until they are covered by another plan.

Data Boundaries

Each seat holder retains full ownership and local control of their own email data. Spamurai does not share email content, classification decisions, or AI prompts between seats in an organization. Owners only see organization-level metadata (member email, linked date, mailbox caps, paused state).

8. BYOK & Third-Party AI

When you use BYOK (Bring Your Own Key) or connect to a third-party AI provider, your email data is sent directly to that provider's API. You are responsible for that relationship and are subject to the provider's terms and privacy policy.

Spamurai's processing limits do not apply when using BYOK or Ollama. API costs from third-party providers are your responsibility.

9. Acceptable Use

You agree not to:

• Use the Service for any illegal purpose
• Attempt to reverse engineer, decompile, or disassemble the App
• Circumvent or manipulate usage limits, billing, or authentication
• Use automated means to access the Service beyond normal app operation
• Interfere with or disrupt the Service or its infrastructure
• Resell, sublicense, or redistribute the Service

10. Intellectual Property

The Spamurai application, website, brand, and all associated intellectual property are owned by Gall Agencja Interaktywna Arkadiusz Galler. You receive a limited, non-exclusive, non-transferable license to use the App for its intended purpose.

You retain full ownership of your email data. Spamurai does not claim any rights over the content of your emails.

11. Updates

Spamurai includes an auto-update mechanism. The app checks for updates on startup and prompts you before installing. All updates are cryptographically signed for security.

We may require a minimum app version to access the Service. Outdated versions that do not meet the minimum may be unable to connect until updated.

12. Service Availability

We strive to maintain high availability but do not guarantee any specific uptime or service level agreement (SLA). The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

We reserve the right to modify, suspend, or discontinue features of the Service with reasonable notice.

13. Limitation of Liability

The Service is provided "as is" without warranties of any kind, express or implied. We are not liable for:

• Email misclassification (important emails incorrectly trashed or spam incorrectly kept)
• Actions taken by third-party services (Google, Stripe, AI providers)
• Data loss resulting from user actions or email provider issues
• Service interruptions or downtime

To the maximum extent permitted by law, our total liability to you for any claims arising from the Service is limited to the fees you have paid us in the 12 months preceding the claim. This limitation does not affect your statutory rights as a consumer under EU law.

14. Account Termination

We may suspend or terminate your account if you violate these Terms. Upon termination for cause, your access is revoked immediately.

You may request account deletion by emailing contact@spamurai.pro. Upon deletion, all your data is permanently removed from our systems (cascade delete), including account data, device records, rules, decisions, and billing references.

Self-service account deletion is planned but not yet available.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Poland. Any disputes shall be resolved by the competent courts in Gliwice, Poland.

If you are a consumer in the European Union, nothing in these Terms affects your rights under mandatory EU consumer protection laws, including the right to bring proceedings in the courts of your country of residence.

16. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, for significant changes, through in-app notifications or email. Your continued use of the Service after changes constitutes acceptance of the updated Terms.
